1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Spirit Animal Fitness Insights website and platform (the "Service"), operated by Spirit Animal Insights, LLC ("we," "us," or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Spirit Animal Fitness Insights is a coaching-intelligence platform for fitness coaches, personal trainers, and gym owners. It provides personality assessments, coaching insights, pulse surveys, client engagement tracking, and branded communication tools to help you better understand and support the clients you already coach.

3. Eligibility & Account Registration

You must be at least 18 years old and legally able to enter into contracts to use the Service. You agree to provide accurate, complete account information (including your gym name and contact email) and to keep it current. You are responsible for safeguarding your account credentials and for all activity under your account.

4. Subscription, Billing & Payments

The Service is offered as an annual subscription currently priced at $19.99 USD per year. Payment is processed securely by Stripe. Your subscription renews automatically each year until you cancel it.

All subscription payments are non-refundable. No refunds or credits will be issued for partial billing periods or unused time. You may cancel your subscription at any time; cancellation stops future renewals but does not entitle you to a refund of the current period.

We may change our fees upon reasonable advance notice. Any price change takes effect at your next renewal after the notice.

5. Acceptable Use

You agree not to misuse the Service, including by: using it to collect data without consent; uploading content that is unlawful, infringing, or harmful; attempting to access another user's data; reverse-engineering or scraping the platform; or using the Service in a way that could damage, disable, or impair it. Violations may result in immediate suspension or termination of your account.

6. Client Data & Coach Responsibility

You collect and submit client information (such as names, email addresses, and assessment responses) in connection with your coaching. You are solely responsible for obtaining your clients' consent to share their information with the Service and for complying with any data-protection laws that apply to you (for example, GDPR or CCPA). We are not a party to the relationship between you and your clients.

We act as a processor of the client data you provide, storing and presenting it to you and (at your direction) to the client. We will not sell the personal data you submit through the Service.

7. Assessments Are Informational, Not Professional Advice

Personality archetypes, coaching insights, and pulse-survey scores are educational tools designed to prompt reflection and conversation. They are not medical, psychological, nutritional, or legal advice, and they do not diagnose any condition. Always use your professional judgment, and refer clients to qualified professionals when appropriate.

8. Intellectual Property

We own or license all rights to the Service, including its software, content, assessment frameworks, and branding. You retain ownership of the client data you submit and any branding you upload. You grant us a limited license to use your uploaded logo and branding solely to display it in your communications and reports as part of providing the Service.

9. Privacy

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you also agree to the Privacy Policy.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any insight or assessment is accurate or fit for a particular purpose.

11. Limitation of Liability

To the fullest extent permitted by law, Spirit Animal Insights, LLC and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to the Service. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right (including your clients' rights) in connection with data you submit.

13. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms, if your account is inactive, or if we stop offering the Service in its current form. Upon termination, your right to use the Service ends. Provisions that by their nature should survive — including billing, intellectual property, disclaimers, and liability — remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated revision date. Your continued use of the Service after a change constitutes acceptance of the revised Terms.

15. Govering Law & Disputes

These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Connecticut for any dispute arising from these Terms or the Service.
